Welcome to Figurement. These Terms govern your use of our website and software service. By creating an account or using our service you agree to these Terms. If you do not agree to these Terms you may not use the service.

Figurement provides a cloud based platform for collaborative visualization configuration and rendering of product scenes and related assets.

Acceptance of These Terms

By creating an account or using the service you confirm that you accept these Terms.
We record the date and version of the Terms that you accepted.

We may update these Terms from time to time. If we make material changes we will notify you through the service or by email. Continued use of the service after such changes means that you accept the updated Terms. In some cases we may require you to accept the updated Terms before continuing to use the service.

Consent Records

When you accept these Terms we record the date and version that you accepted.
We may also store limited technical information such as your IP address and browser user agent at the time of acceptance. This is done only to document that the acceptance was valid and to prevent fraud. This information is handled in accordance with our Privacy Policy.

Eligibility

You may use the service only if you are at least 18 years old capable of entering binding agreements and acting in compliance with applicable laws. If you are using the service for an organization you confirm that you are authorized to do so.

Your Account

To access certain features you must create an account. You are responsible for:

• Providing accurate and current information
• Keeping your login credentials secure
• All activity that occurs under your account

If you believe your account has been accessed without authorization you must notify us promptly at hello@figurement.com.

Use of the Service

You agree to use the service only for lawful purposes. You must not attempt to copy alter disrupt or misuse the service. You must not upload any content that is unlawful harmful obscene misleading or that infringes the rights of others.

We may suspend or terminate accounts that violate these Terms or create a risk to the service.

No Competitive Use

You may not use the service in order to develop or improve a product or service that competes with Figurement. This includes using the service to study user interface design workflow patterns feature behavior rendering techniques or other functionality for the purpose of creating a competing product.

You may not access the service in order to benchmark performance evaluate internal architecture test system behavior under load or derive technical implementation details except as part of normal use of the service.

You may not copy reproduce distribute or adapt any part of the service for the purpose of offering it as your own product or as part of another product.

This does not restrict your right to independently develop software that is similar in purpose as long as you do not use the service or content provided through the service to do so.

Intellectual Property

All rights in and to the service including software interface design data models and branding belong to Figurement ApS or our licensors. You receive a limited non exclusive non transferable right to use the service for your internal business or personal use. No other rights are granted unless stated in writing.

Subscriptions and Billing

We may offer paid subscriptions. Payments are processed securely by Stripe Inc or other authorized providers. By subscribing you authorize recurring charges where applicable. You are responsible for providing accurate billing information.

Trial and Beta Access

We may offer free trials or early access features. These are provided on an “as is” basis and may change or be discontinued at any time.

Privacy

Your use of the service is subject to our Privacy Policy which explains how we collect use store and protect personal data.

Availability

We work to provide a reliable service but uninterrupted availability is not guaranteed. Temporary downtime may occur for maintenance updates or unforeseen technical issues.

Limitation of Liability

To the fullest extent permitted by law we are not liable for indirect special incidental punitive or consequential damages.
Our total liability for any claim is limited to the amount you paid in the 12 months before the claim arose.

Nothing in these Terms limits liability that cannot be limited by applicable law.

Termination

You may stop using the service at any time.
We may suspend or terminate your account if you violate these Terms or create a risk to the service or other users.

Upon termination access to your data may be limited or removed in accordance with our data retention practices.

Governing Law

These Terms are governed by the laws of Denmark. Disputes will be resolved in the courts of Denmark unless otherwise required by law.
